You really need to take this thing all the way to real court. They will weigh the expense of going to court vs. the expense of giving you a new boat while considering the fact that they will probably lose and have to pay for your legal fees as well as whatever else your lawyer can get you. It supposedly costs a big company 20K to go to court over a consumer claim. Let us know how things go.

In addition to what I just said, why is the dealer not backing you? Does he have some vested interest in Carolina? He should be the one on your side fighting with them to make this right. I would also sue him for whatever you can- if the boat isn't supposed to handle that motor it is his fault for putting it on the boat. I don't agree with these yahoos who think that you're some kind of communist for wanting to be treated fairly.

Update 2:

The boat is back at the Metro Boating and Carolina Skiff says they will put it on one of their trucks dead heading back to Georgia (since they said it in court I guess they have to do it). When they get it, they will look at it and go from there.

I'll keep ya'll up on what happens.

Sorry to hear about your trouble Over the Line.
For whatever its worth I run a 2007 J16 with a 35 Mudbuddy Hunter with carb and dual exhaust. Its far from the ideal hull but I like the full flotation in the floor and the price was right($1200 brand new). That said it will run 30 one person. With 3 people and a load it runs low 20's. Very, very careful attention must be paid to proper weight distribution with that kind of weight in the boat though. If you need documentation from me that a J16 will run with a mud motor let me know, glad to help if I can. I'm always on the lookout for a good used true mud hull but til then I'm running this. Mine has held up well so far, sounds like you got a bad hull. Good luck.
