I have an employee here in La and they did not blow. Lost their license for a year. No priors. Get you a good lawyer. Having to pay money is one thing, being without a license for a year would be hard to do.

You'll lose your privilege to operate a boat for a year until you complete a DUI class. Think it's limited to 10hp and smaller. Also charged with MISD...+/- 12 month probation + fines & fees.

Oh yeah.... add on +/- 40 hrs comm service.

Maybe a clinical evaluation for substance abuse.

BUI laws changed in 2013 after the accident on lanier. Got stiffer, lowered level to .08 instead of .10

Don't ever blow. Sorry about your luck. I blew on my second time, went to jail and never lost my license. Good chance the officer made a mistake, a good lawyer will find that. My man don't play.

If you never blew, even in the facility, and no blood test, fuck em, they can't do anything now.

No test changes the ball game. Burden of proof lies with the state. Can they prove you were drinking? Any field sobriety test?

I did the sobriety test, they can prove I was drinking. They just don't know if I had a single beer or a 12 pack. Like I said I wasn't drunk, I had a few beers but far from drunk. There's a chance I could have blown and been under limit. I just wasn't taking that chance of blowing over and giving them a number in court.

Refusing to blow initiates administrative penalty of suspension of drivers license. This is wholly separate and apart from the actual DUI charges and trial,

refusing test is something to do with implied consent laws up here - what ever it is where you're at better get legal counsel ASAP, they can give you better advice than us and some of the legal loop holes are time sensitive

I had a police pull in behind me at my brothers house for a tag light. He then saw a open 30 pack (that was hot since I was the dd that night) and said I had to blow to which i basically told him to phuck his self. Well he called another officer that happened to be a long time friend and his sargent. Needless to say I got a full apology.

Ugh, I wouldn't advertise on here what he drank. It's routine for DA's and investigators to dredge the internet for evidence. Doubt they would do it for a dui, but your never know.
