 What to do?
Fella's , I need a little help deciding what is the best decision I can make. The wife works night shift at the hospital ,and on the way home last thursday morning she went to Smoothie King for a fruity beverage. Well low and behold the little girl waiting on here kept her debit card. Karrie was on her last shift for the week and tired. The young lady racked up around $350 on it. The funniest of it all was the $141 at fantastic sams. How in the hell do you do that? So,after a little investigation I found out who had it. Well her mother called me tonight to make it right. We already turned it over to the bank . Should I give the young 16y/o a break and tell the bank to quit the claims investigation and just let her mom pay me back,or let the bank deal with her? BTW, we did cancell and get new cards. tThanks in advance. Jason

I don't post much, but I say time to teach her a lesson. If mom bails her out now, she will just steal from the next customer. If she is worried about "having a record", then a judge can probably work something out. She should be responsible for her decisions. Good luck I know these things are a hassle.

I wouldn't stop the investigation until you get your money back. If the mom can make it right like first thing in the morning, I'd think about it. Its really up to you man. Some people need a swift kick in the ass to learn a lesson. And some can realize they have been given a good break and straighten their act up on their own. And some just won't learn no matter what, so you might as well kick them in the ass. Just depends how you feel about which category this little girl falls in to.

The mom wanted to come over tonight,but I told her the wife wasn't here for me to talk to. She also offered extra money for our troubles that I respectfully declined. At this point I'm thinking its the bank decision. We just want our hard earned money paid back in full.

Is her mom hot? No, seriously if you think her parents are the type dat will actually dish out a servere enogh punishment to were dis girl will learn a lesson then I can see givin her a break. But if she got parents like so many others these days dat will do sumthin like take der cell phone away for a week  then let da bank do there thing. Bottom line is if she don't learn now she will be in jail later.

If she broke a window or something like that on accident (or on purpose) I'd maybe give a break but stealing a debit card is some pretty major $hit. No telling if she did that to someone else.
She didn't feel sorry when she was using the card you can bet on that. She's just sorry she got caught.

I think I would like to witness da ass whoopin and put it on you tube. Public humiliation will leave a lasting impression. Me and my little brother would allways fight as kids and no amount of beatins from our father would teach us a lesson. My father finally made us sit at da end of da drive way by da road and made us hold hands. After dat we did not fight nearly as much.

I need a lil more info here. Ya say you found out who it was & her mom contacted you, there's no mention of her feeling any remorse. Is she just a kid that gave into peer pressure after honestly forgettin to give the card back, or is she another lil punk brat teen that has no respect? I say either way, ya file charges on her azz. If she seems to honestly regret her big mistake, then speak on her behalf in court & try to get her adjudicated probation. That way she'll learn her hard lesson, but it won't haunt her forever when trying to get a good job, etc. If she's a lil punk, hang her lil azz in the court room.

I wouldn't stop the investigation, like they said before her going to court will be a needed wake up call. Being a juvenile and maybe a first strike they wont give her much anyways...not like she is going to jail for life. I think she needs this tell help her straighten up. It may or may not help, two of my cousins have been in and out of jail since they were 12 and 13. They are now 27 and 28 one has finally straightened up and one is still in jail.

I contacted the tanning salon on saturday after getting back from the ride and was told the owner would get back with me on thursday(today) after she gets back from vacation. She knew exactly who it was. The owner herself had idenity theft twice this year, so was very helpful and willing. So from there it triggered me to start making calls to the other stores to try and find more info. Then I called smoothie king to see if she was even a employee there. In the meantime the tanning salon owner had called her mom to make sure she knew and that she would want her money too if their was a problem. She also gave the mom my contact info ,and the mom did so in a prompt manner. All of this mini investigation by myself all went down between 3pm and 7pm today.

Wow.... keeping the card is really stealing the card, using the card is stealing your money, IF she had signed your wife's name at all it would have been a clear case of fraud. With her signing her own name, not sure if that still counts, but as she's not an authorized user, it's probably still fraud. This isn't like she saw your wife drop a $1 and didn't say anything. Stealing is stealing..... what if it was your boat and MM that she stole and she and some freinds trashed it, blew the motor and hooked the hull?
My neighbor had to fire someone for stealing $2 from multiple soda machines. He always told new hires, don't steal, it's not the last time that you steal (when you get caught) that's the problem, it's the first time that's the problem because you lost respect for what you stole (money or items). Once you cross that line and lose respect for other peoples belongings or money, it takes a major cause to reinstate that respect. Some people never get that back regardless of what punishment they get. Some people get scared straight, really quick.
I've seen way too many parents let kids get away with things when they said that they were going to punish them. Therefore the kids never learn that there are consequences to their actions. I was told that if I did something that I shouldn't have and I got caught, that I'd have to "pay the piper" with the police THEN have to deal with the rathe of the parents.
The fact is that she used the card, she made the decision, now she needs to learn the consequences. Keep the bank and police involved and let her feel the heat. If she looks like she really is sorry and it's her first offense then MAYBE speak on her behalf. BUT maybe it's her first offense because her parents bailed her butt out before, you don't know that. I think if more people had to take the consequences of their actions instead of having others bail them out, society would be much better off.

Bein' that I am somewhat an authority on this very subject matter .... I too had an 16 year old daughter that gots caught up in a mishap ...... I shall respond to this thread.
First Off ~ She ain't yore daughter ..... so that ain't yore problem.
Second Off ~ You and yore wife is the victom ...... you should act as such .... meanin' .... full restituions with all outside expences paid ..... with a letter of appoligy from the young lady ... not really much more.
Third Off ~ Believes me when I type .... When that young lady and her dad/mother stands befo the judge and the Man looks down his long nose and points that long finger to that young lady and issues the legal matters to her ....... she WILL become a better citizen to the community and quite possible save her life. It really wasn't her fault ..... I know .... Ya'lls ain't gonna agree with me on that ..... but it's the truth. At 16 .... she knows right from wrong ..... she just chose wrong this time and the Judge knows how to put the handle on it.
Good luck to you and yes I will say a small prayer fo the young lady that she will learn from this mistake and move forward to make her parents proud !!!!

Man thats a tough one for sure.... Lots of options.... Go with your heart...
My girlfriend (Amanda) took her sister to court for stealing a ring and pawning it off.... Its called tough love,, Manda had tears in her eyes when she told the judge that she was doing it for her sisters own good... It was hard for me to watch.... The judge handed down the sentence after the ass crawling he gave her sister.. forget how many hour of service, pay the money back for Manda getting her ring out of pawn, court cost, that aint cheap and put her on diversion for a year...
She was just going to kick her ass real good but I talked her into the legal route... Hell then it would had cost me money to get Manda out of jail on a DV charge....
If your not wanting to go all out and cause the girl to have a felony follow her around the rest of her life if you take her to court ( not that its your falt )... Check in on getting her put on diversion, and still give her that felling of life passing before her eyes...
Just my .02....

Get the money in hand then turn it over to LE. File a report,write a statement and let the prosecutor make the call on charges. The problem is that this little filly might be on a ride with other cards too. You may not be the only victim. You might be the solution to several other crimes. Randy

She is young, she will get over it no matter how severe the charges, so she deserves for it to linger as long as it can. That's serious shit, I see enough good people having to put up with people taking from them with no repercussions, it's time for people in this world to be held accountable.
