For the Newbies: Gator-Tail Says Mud Buddy Infringed Outboard Patents Gator-Tail Outboards, a maker of boat motors designed by perform in shallow water, accused a Utah company of patent infringement. Gator-Tail outboards, made in Loureauville, Louisiana, are covered by three patents at issue in this case. Mud Buddy, and Mud Buddy Manufacturing, based in Sandy, Utah, make and sell infringing motors, according to the complaint. The three patents in dispute -- 7,297,035, 7,048,600 and 7,052,340 -- are for air-cooled outboard motors for small marine craft that operate in shallow water. Kyle Broussard of New Iberia Louisiana, is co-plaintiff with Gator-Tail and owns both the '600 and the '340 patents. Gator-Tail is licensee for the '035 patent. All three patents were issued between May 2006 and November 2007. The motors Gator-Tail makes are for flat-bottomed boats used for hunting, fishing, harvesting crawfish and maintenance of oil-industry infrastructure, according to the company's lawyer, Juston M. O'Brien of New Orleans' McGlinchey Stafford. MudBuddy's Hyperdrive and HD series engines infringe these patents, Gator-Tail said in court papers filed in federal court in Baton Rouge, Louisiana Feb. 29. In addition to O'Brien, Gator-Tail and Broussard are represented by Joel W. Mohrman and Anderson L. Cao, both from McGlinchey Stafford. The case is Kyle Broussard v. Mud Buddy, 3:08-cv-00125-JVP- CN, U.S. District Court, Middle District of Louisiana (Baton Rouge). Woody |
