Just got served lawsuit papers for my 8 month old rotty making someone fall down. They are suing for 500,000. He did not bite he just made someone fall. This country has become a place that you had better have a good lawyer and good insurance. I hope I have good insurance, will find out Monday. It can turn from sugar to shit very quick. All you dog owners had check to make you are covered. Never thought this would happen to me.

He was goin to sniff there dog and they grabed my dogs collar and fell down. Claiming mental,physical and emotional damage from this.

was moving my boat from back to front yard. Gate was open for 1 minute, he got out when I had my back turned. Ran to get him and asked if she needed any help, she said no Im ok and your dog shur is handsome. I asked if I could take her somewhere. Said she was ok and walked off. Nowdays people will sue over anything. That is why insurance is so valuable now. I hate it but that is how it is now.

what a sad world we now live in. I hope your covered good and that the judge throws it out. My brother in-law got in a wreck a while ago and the couple tried suing for loss of intimacy because every time they went to do it, they would get flashbacks from the wreck........a bumper fell off. Judge decided that was bullshit

My buddy was here and is going to tell them that she attacked my dog. Hell all he was goin to do was smell the dogs ass. He wouldn't attack no one unless they were goin to harm me or family.

Hate to say it,,,but my ole man been in that predicament.

The way the court system is today, the only sure shot you got is to not own dogs like that....Good posibility insurance will settle and drop you....

What else will be taken away from us as citizens in this country. Our dogs, weapons, jobs, the American dream, my house, what I can eat or drink and who knows what is next. Things have really changed for the worst in my 52 years and are not going to get any better for the working class.

They should change the system in this country. Bull Shit Law Suits cost us all. I think it was England that changed their system to the plaintiff is automatically required to pay ALL court cost if they lose. That would put a kink in the you don't pay unless WE win advertisements.

Just a FYI certain breeds of dogs void many homeowners policies. Same goes for a trampoline. Not sure it would cover anyways seeing as this happened on sidewalk or street (county, city property). Pit bulls, dobermans, rotts, etc. Trial lawyers and big unions are the scum of this country. I'm sure that's not popular around here because many of you offshore, firefighters, oil guys are union card carriers. Just my honest opinion.

I know I haven't been a member of this forum long and don't have any rapport here. But I do live in Ms and more importantly am licensed in property and casualty insurance. I don't know what carrier of insurance you have but it doesn't really matter. Every member of this site who has a dog needs to purchases a PLUP. This is a personal liability umbrella policy and is specifically designed for just these types of occurrences. Please everyone speak with your insurance agent about a PLUP. A common limit on this type of policy is a million dollars. God knows we all need it because it seems everyone out there is willing to file papers to get something out of nothin.

We have had some tort reform but the risk is still prevalent. Liability is the cheapest form of insurance. A million dollar personal liability umbrella policy may cost 300 bucks a year.

First off the ammount she is suing for will NEVER be awarded, and with a good lawyer will probably get laughed out of court.

Second insurance is not as good as you (or i did) may think. If you have a standard homeowners policy with no "umbrella" your probably not covered for such an incident up to or anywhere near 500k. Not to mention the spineless insurance companies sometimes put fine print clauses in regarding dogs etc especially dogs preceived as "dangerous" (pits, rots, german sheperds, etc). If the dog isnt on the policy as in insurance doesnt know about him or her, they wont do anything for you most likely.

Im sure youll be fine but i bet your stuck paying your lawyer. if the insurance company does come to your aid they will do one of two things after the fact, drop you or bump your premiums through the roof.

Im sure you or anyone else wont read this rant but insurance has really p*ssed me off lately. basically i recently went through a home owners claim after YEARS of paying premiums with never a hint of a claim. all ill say is if you get sued for a BIG dollar amount you'll get left paying a big chunk of it and if its a fire or theft claim..... forget it they act/ think you stole or set it. just my 2 cents.

Post a copy of the suit. You can redact the names if you want. Let's see what the victim had to say about what happened. In louisiana one can no longer state the general damages amount he is claiming so if the suit were here it would say you owe what is reasonable under the premises if you win.

My own lab has wrenched my shoulder a few times so its not like dogs can't cause injuries other than just from biting someone.

By your own admission here you say he was let out by your own negligence. He was not on a leash and most places have leash laws. So far, this is slam dunk case for the victim. The real battle will be proving injuries. I can just about predict she'll have hospital bill and secondary treatment, at minimum. If just that and only soft tissue injury her case is worth between $3,000 and $5,000, plus medical bills, at most. The value goes up from there depending on injury, duration, medical bills and many other factors. Lets hope your case is in the lower range.

And be careful what you post on forums. I ask questions at depositions all the time now about participation in online forums, Facebook, etc. and an amazed by what I've discovered.

I bet Dguidry can give us some first hand examples of judges with "blood on thier hands"....

eg. Making a call not to protect a child, and that child being beatin/harmed. Or maybe giving a damn child molester probation and him have to register a sexual predator, only for him 2 months later to rape and kill a kid????

Im sure this has happened, but what can you do when he is sworn into a job that he is given "ABSOLUTE IMMUNITY"????? Fucked up if you really read into it...

A judge cannot be held accountable for his actions unless you can prove he acted outside the confines of the law!!! Here is the kicker......A panell of judges has to determine this!!! :lol: :lol: :lol: What a joke!!! Useless law is that that is....Do you really think they will open "pandoras box"?

Most judges have a special place in hell if you ask me....

I posted this before I talked to my insurance lawyer. They said it will take a year for this to be taken care of and do not talk about the case. So I will take the fifth on this till it is over, then I will let yall know what happens. Thanks for the input.

What's happened so far? The insurance company will probably just settle out of court for a much smaller amount..that's why her suit is for so high, she's trying to get the most she can. Have you called your insurance agent yet?
