I'm not a lawyer or know the law by any means, but yes, where we will be riding is "open waters" and you can ride in it, but since it is privately owned, stopping on it, say for a few beers, might be a different story without the owners permission. I might be wrong, get the Texas hammer to chime in for us.....

Some of you guys are outta control lol. You are not signing the waiver to grant you permission to ride on a public waterway, you are signing the waiver so that if anything happens the people involved wont get sued. Talk about some ego problems. If someone can sue mcdonalds for hot coffee then surely someone could sue if they got in an accident at an event that is sponsored. Hell I've asked people to fish in there ponds before and they told me no because if I were to fall in and drown they could be sued. Its the world we live in today and we can thank the ambulance chasing lawyers for it(dguidry not pretaining to you just stating a fact and im sure you can agree). Just sign the waiver so the sponsors can cover there bases and have fun.

i think it should say
you can sue anybody for wrong doing. However, by signing this waiver you revoke your right to sue the companies who sponsored the event. The companies are NOT liable for actions of individuals who are partaking in this event. if you trash the place you are subjected to a beat down behind the dumpster. If you so choose to litter you revoke your right to sue anyone for anything including a ghetto ass beating behind the dumpster.

sign your fucking name here______________________

Everyone here signs contracts all the time without realizing it, getting a cell phone, paying with a credit card, getting a gym membership. Theres so many fine print provisions stuffed in that paperwork giving up all your rights and no one ever reads it. All I have to do is sign a piece of paper that says I wont sue the volunteers or sponsors who put this on if El Jefe rams into my ass.... where do I sign.

My understanding is that forms signed or not, proven negligence will still get you sued. Is this correct, Dguidry?

To the OP, I think you went about this the wrong way. It's already been stated, but x2 for just stating I'm a event sponsor and not a responsible party. BOOM. problem solved.

Serious question for a second though.

Guidry,

Would that waiver hold up in court?

I know this has been said earlier, but this event is a voluntary attendance deal. The guys that are organizing are not asking you to perform a task against your will. IMHO, if you want to attend the event, sign the waiver. If not, buck off. Just don't hang out and be a poser, eat free food but bitch about the other requirements. Seems like folks are making a big deal out of nothing.

Isn't it sad some people are such sorry pieces of shit that it is necessary to sign a waiver?

No wonder all the big rides don't happen anymore.

I got news for you Coe... A piece of paper isn't going to protect you. Big groups=trash all over the place=bad publicity for mud motors.

Post subject:  Re: Comment Thread - Release Form

To add a little more insight to the thread, if some dumbass runs over someone because he was drunk or just acting stupid, the people he hit can of course sue the guy and the guy would deserve it. No problem there. The form is only there for if that would actually happen, the companies who only wanted to help make t-shirts don't get in the suit as well.

That's all it is. And yes, I agree that the waiver might not keep any sponsor from getting sued, but it would sure be better to be sitting in court with it than without it.

Let's all have fun and enjoy the ride. Signing a piece of paper at the launch ain't gonna kill anyone and to be honest folks should be glad to sign it as a thank you to those who busted their asses to put the thing together.

Post subject:  Re: Comment Thread - Release Form

I really dont understand why people would rather not go than sign a form saying you wont sue a sponsor if your dumb ass gets hurt? Its people like you that are the reason for no pledge in schools and eventually "in God we trust" off the dollar. Just gotta pick at anything and everything that really shouldn't matter. You just "feel" the need to speak your mind. Sign the damn form and lets have some fun.
